1. Acceptance of Terms

By accessing and using Cortex Athletics ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

Cortex Athletics is an AI-powered fitness coaching platform that generates personalized training plans for athletes training across multiple sports. The Service uses artificial intelligence (currently Google Gemini) to create customized workout schedules based on your profile, fitness goals, sport preferences, and physical condition. Currently supported sports include gym (weight training) and running. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You must be at least 16 years of age to create an account. By registering, you confirm that you meet this age requirement. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or illegal content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Use the Service for any commercial purpose without our written consent
• Impersonate any person or entity

5. Intellectual Property

5.1 Our Content

The Service and its original content, features, and functionality are owned by Cortex Athletics and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 User Content

You retain ownership of any content you submit, post, or display on the Service. By submitting content (such as workout logs and profile data), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for the purpose of providing and improving the Service, including generating AI-powered training plans.

6. Payment Terms

The Service currently offers a free tier. Paid subscription plans may be introduced in the future. If and when paid plans become available, this section will be updated with detailed payment terms, and you will be notified of any changes before they take effect. Your continued use of any paid features will constitute acceptance of the applicable payment terms.

7. AI-Generated Content and Health Disclaimer

7.1 AI-Generated Training Plans

Training plans are generated using third-party AI services (currently Google Gemini). To generate your plan, we transmit your profile data (age, gender, weight, height), sport preferences, active injuries, and recent workout history to the AI service provider. The AI output is algorithmic and may contain errors or inaccuracies. You are responsible for evaluating whether any suggested exercise is appropriate for your fitness level and physical condition. We do not guarantee the accuracy, safety, or suitability of AI-generated training plans.

7.2 Not Medical Advice

CORTEX ATHLETICS IS NOT A MEDICAL SERVICE. THE AI-GENERATED TRAINING PLANS ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL BEFORE STARTING ANY NEW EXERCISE PROGRAM, PARTICULARLY IF YOU HAVE INJURIES, HEALTH CONDITIONS, OR PHYSICAL LIMITATIONS. YOU EXERCISE AT YOUR OWN RISK.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at contact@taskero.de. Upon termination, your data will be deleted in accordance with our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASKERO UG (HAFTUNGSBESCHRÄNKT) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THIS DOES NOT AFFECT LIABILITY FOR DAMAGES ARISING FROM INJURY TO LIFE, BODY, OR HEALTH, OR FROM THE BREACH OF ESSENTIAL CONTRACTUAL OBLIGATIONS, OR LIABILITY FOR INTENT OR GROSS NEGLIGENCE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Taskero UG (haftungsbeschränkt) and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mainz, Germany. If you are a consumer within the EU, you also retain the protection of the mandatory provisions of the law of your country of residence.

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
